Title IX

The Medford School District does not discriminate on the basis of sex and prohibits sex discrimination in any education program or activity that it operates.

What is Title IX?

No person in the United States shall, on the basis of sex,  be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

To report information about conduct that may constitute sex discrimination or make a complaint of sex discrimination, an employee, student, parent/guardian, community member, or concerned citizen should promptly contact a Medford School District supervisor, administrator, or other district official.

Inquiries about the application of Title IX may be referred to the District’s Title IX Coordinator, the Office of Civil Rights, or both.

Oregon Sexual Harassment Investigation Process

  • Upon receiving a complaint, the district will initiate an investigation and notify concerned parties of the initiation of an investigation
  • The official will arrange meetings with concerned parties; Parties will have an opportunity to submit evidence and a list of witnesses
  • Findings will be reduced to writing
  • The official will notify the parties in writing at the investigation’s conclusion; If a violation of the policy was found to have occurred, within 30 days of the receipt of the report
  • The complainant may appeal the outcome of the investigation if not satisfied with the decision (see complaint procedure for details).

Federal Law (Title IX) Sexual Harassment Investigation Process

  • Upon receipt of a formal complaint, the District will provide written notice to both parties
  • The Title IX Coordinator (or designee) will contact both parties to discuss supportive measures
  • The Title IX Coordinator will coordinate the district’s investigation
    • Parties may request Informal Resolution (a voluntary structured interaction between involved parties to resolve the allegations without going through the formal complaint procedure). 
    • Title IX Grievance Process - If both parties don’t agree to use informal resolution, the District is obligated to follow the Title IX grievance process, which consists of:
      • Investigator – An investigation, following specific rules, will be conducted (includes an interview notice to both parties, the sharing of evidence with both parties, the opportunity to respond to evidence by both parties, the sharing of an investigative report at the conclusion of the investigation, with an opportunity to respond in writing, by both parties);
      • Decision Maker – Will make a final determination on the merits, including findings of responsibility and remedies;
      • Appellate Decision Maker – Is responsible for overseeing the written appeals process and making a determination regarding timelines and appeals procedures.
